Bidsify

Terms of service

Last updated 29 October 2026

These terms are an agreement between the business that installs Bidsify ("the store", "you") and Akioora LLC, a Delaware limited liability company that operates Bidsify ("Bidsify", "we"). By installing or using Bidsify you accept them on behalf of your business. Shopify's own terms also apply to your use of Shopify and the Shopify App Store.

1. What Bidsify does

Bidsify lets a store run timed and sealed-bid auctions on its products. Bidders sign in with their Shopify customer account, and winners pay through the store's Shopify checkout or a Shopify invoice. Bidsify never takes or holds payment for an item: each sale is between the store and the bidder, and the store is the seller.

2. Your responsibilities

3. Acceptable use

You may not use Bidsify to:

4. Plans, billing and license keys

5. How we process your customers' data

This section is our data processing agreement. It applies when Bidsify processes personal data of your customers (bidders) for you, including under the EU and UK GDPR and US state privacy laws such as the CCPA.

  1. Roles. You are the controller of your bidders' personal data and we are your processor (a service provider under the CCPA).
  2. What we process. Subject matter: running your auctions. Duration: while Bidsify is installed, plus the deletion periods below. Data subjects: your customers who bid or watch auctions. Personal data: Shopify customer ID, name, email, phone, shipping address, alias, bids, wins, payment status, email choices and staff notes. No special category data. Details are in our privacy policy.
  3. Your instructions. We process this data only to provide Bidsify as you configure it, which is your documented instruction, and as the law requires. We'll tell you if we think an instruction breaks data protection law. We don't sell or share it, or use it for our own purposes.
  4. Confidentiality. Everyone at Bidsify who can access the data is bound by confidentiality.
  5. Security. We keep appropriate technical and organisational measures in place, including encryption in transit, a private database network, encrypted backups, restricted staff access with two-factor sign-in, and an audit log of staff actions.
  6. Sub-processors. You authorise the sub-processors listed in our privacy policy. We bind each one to data protection terms at least as protective as these, and we remain responsible for them. We give at least 30 days' notice of a new sub-processor by email, and you may object and uninstall if you don't agree.
  7. International transfers. Where data leaves the EEA, UK or Switzerland, we use the EU-US Data Privacy Framework or the European Commission's standard contractual clauses.
  8. Helping you. We help you answer your customers' requests to access, correct or delete their data, including through Shopify's privacy webhooks, and with security, breach notification and impact assessments where needed.
  9. Security incidents. If we become aware of a breach affecting your customers' data, we tell you without undue delay and within 72 hours, with what we know and what we're doing about it.
  10. Deletion. When you uninstall, we delete your auctions, bidders and settings when Shopify asks us to (48 hours later), and backups expire within 30 days. When a customer asks you to delete their data, we remove their personal details as soon as Shopify tells us.
  11. Audits. We give you the information you reasonably need to show compliance, and answer reasonable written questions about our measures. Ask at support@bidsify.com.

6. Our service

We work to keep Bidsify running and to close every auction on time. If closing is delayed, auctions close as soon as the service is back, using the bids placed before the end time. We may change or improve features, and we'll give notice before removing one you rely on. Support is by email at support@bidsify.com.

7. Ownership

You own your store's content and data. We own Bidsify, its software and its branding. You give us permission to use your data only to provide Bidsify to you. If you send us feedback, we may use it without obligation.

8. Disclaimers

Bidsify is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including that the service will be uninterrupted or error-free, or fit for a particular purpose. We are not a party to any sale and aren't responsible for items, payments, shipping or disputes between you and your bidders.

9. Liability

To the extent the law allows, neither of us is liable to the other for lost profits, lost sales, or indirect, incidental or consequential losses. Our total liability under these terms is limited to the greater of what you paid for Bidsify in the 12 months before the claim and US$100. These limits don't apply to liability that can't be limited by law.

10. Indemnity

You will defend and compensate us against claims from third parties, including your bidders, that arise from your auctions, the items you sell or your breach of these terms.

11. Suspension and ending

You can uninstall Bidsify at any time. Running auctions are cancelled at uninstall, and your data is deleted as described above. We may suspend or end your access if you seriously break these terms, after telling you why and, where practical, giving you time to fix it. Sections 5, 7, 8, 9, 10 and 12 continue after these terms end.
